    CANCELLATION:
    1. MTC has the rights to cancel this order if the Purchaser does not comply with the terms and conditions of sale or becomes bankrupt or insolvent. In the event of such cancellation, MTC will be compensated for any loss resulting therefrom.
    2. Acknowledged orders are not subject to cancellation by Purchaser except upon written approval of MTC upon terms that will indemnify MTC against any loss to MTC resulting from such cancellation.
    WARRANTY:
    1. There are no warranties express or implied by MTC in connection with this sale. The goods that are subject to this sale have been manufactured by others and all such warranties, express or implied, are those extended and are hereby expressly limited to the warranty of the original manufacturer of the goods.
    2. MTC EXTENDS TO PURCHASER, AS TO PRODUCTS MANUFACTURED AND SUPPLIED BY A MANUFACTURER TO MTC, ONLY THOSE WARRANTIES EXPRESSLY EXTENDED TO MTC BY THE MANUFACTURER IN MTC'S CONTRACT OF SALE WITH MANUFACTURER ON FILE AT THE OFFICES OF MTC. THIS WARRANTY IS THE ONLY WARRANTY EXTENDED BY MTC IN CONNECTION WITH ANY SALE MADE HEREUNDER AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PURPOSE.
    3. There are no other warranties, express or implied, that extend beyond the warranty of the manufacturer of the goods and any other statements, oral or written, inconsistent with such warranty, are not binding on MTC. Performance and production data, including accuracy, capacity and capability of machines and tools are estimates only and not guarantees since they are dependent upon varying future production factors and conditions not with MTC control.
    4. No agent, employee or representative of MTC has any authority to bind MTC to any affirmation, representation or warranty concerning the goods.
    5. MTC shall have no obligation to install or provide improvements or changes in design adapted by the manufacturer or MTC for similar goods subsequent to acceptance of Purchaser's order.
    6. MTC assumes no liability for any consequential damages or loss of profits arising from the breach of any warranty or from any delay in delivery or from any other cause whatsoever.
    F. PURCHASER'S USE:
    1. User shall require all persons operating the product to use any and all proper, safe operating procedures set forth in operator's manuals and instruction sheets relating to products and any and all available feasible and practical point of operation safety devices consistent with Purchaser's use of the product.
    2. PURCHASER SHALL NOT REMOVE OR MODIFY ANY DEVICE, WARNING SIGN, OPERATOR'S MANUAL OR WORK HANDLING TOOLS INSTALLED THEREON OR ATTACHED UNLESS EXPRESSLY AUTHORIZED BY MTC IN WRITING.
    3. Purchaser shall notify MTC promptly of any accident or malfunction involving product and cooperate with MTC in investigating and determining the cause of any such accident or malfunction.
    4. It is the user's responsibility to provide all proper dies, devices, tools and means that may be necessary to effectively protect all personnel from serious bodily injury which otherwise may result from the method of particular use, operation, setup, or service of the machine, The operator's or machine manual, ANSI Safety Standard, OSHA Regulations and other sources should be consulted to implement the above.
    5. Purchaser shall hold harmless and indemnify MTC for any personal injury claims or lawsuits resulting from modifications by purchaser of any product sold by MTC wherein the modification was not authorized by MTC in writing.


  • Shipping & Delivery
  • At this time, Machinery Trade Center ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. Additionally, Machinery Trade Center ships merchandise to Canada and Mexico, but not to other international locations. The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.

  • Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.
